Can you remove or change planning conditions?

If you are unhappy with any conditions of your planning approval then you will be pleased to know that it is possible to have conditions removed or amended.

However, it is also important to note that there is no guarantee that it will be possible. Given that you would need to request the removal or amendment with the same planning authority who imposed the condition a very strong case will need to be put forward to justify why they should agree to your request.

The good news is that if you want to request the removal or amendment of any planning conditions then you can do so without risking the approval being overturned. The reason is that your planning authority will only assess the condition(s) in question rather than the entire application.

The best-case scenario is that they agree to your request; however, it is also possible that they refuse your request and even add further conditions. Unfortunately, as with planning applications it will take your planning authority 8 to 13 weeks to process the application and reach a decision
